    • Marvel Studios has filed a DMCA subpoena with Instagram’s parent company, Meta, to uncover the identity of the leaker behind the “CanWeGetSomeToast” account.
    • The subpoena seeks crucial identifying information, including the account owner’s name, physical address, IP address, telephone number, email address, and payment account details.
    • Marvel’s legal strategy is aimed at deterring future leaks and preserving the element of surprise for audiences.
    • This legal action reflects Marvel’s ongoing efforts to combat unauthorized leaks and spoilers related to its projects.
    • The outcome of this case may have far-reaching implications for online spoiler culture and the enforcement of copyright laws.
    • Marvel’s commitment to protecting its intellectual property underscores the importance of safeguarding creative content in the digital age.

Marvel Studios has taken legal action against a prominent social media account known for leaking confidential information about upcoming Marvel Cinematic Universe projects. The account in question, “CanWeGetSomeToast,” has gained notoriety for sharing spoilers, casting news, and leaked images and footage from Marvel films before their official release.

Recently, CanWeGetSomeToast shared unreleased footage from the upcoming film Captain America: Brave New World on Instagram Stories. This prompted Marvel to take swift action, filing a Digital Millennium Copyright Act (DMCA) subpoena with Instagram’s parent company, Meta, to uncover the identity of the individual behind the account.

Marvel’s VP of Global Security and Content Protection, Matthew Slatoff, spearheaded the legal effort by submitting a sworn declaration stating the purpose of the subpoena: to identify the alleged infringer(s) responsible for posting copyrighted material without authorization.

The subpoena aims to obtain crucial identifying information, including the account owner’s name, physical address, IP address, telephone number, email address, and payment account information.

Marvel Studios has issued a DMCA subpoena to discover who's behind the social media account that has posted various Marvel leaks including a pre-release image from ‘CAPTAIN AMERICA: BRAVE NEW WORLD’

    Context and Precedent

This is not the first time Marvel has taken legal action against leakers. In the past, Marvel has successfully addressed leaks by issuing DMCA takedown notices and copyright infringement claims. Notably, leaked scripts and images from films like Ant-Man and the Wasp: Quantumania and Captain America: Brave New World have been swiftly addressed to mitigate potential damage to the studio’s intellectual property.

The pursuit of legal action against CanWeGetSomeToast signals a significant shift in how Marvel Studios intends to handle leaks and spoilers moving forward. By targeting high-profile leakers, Marvel aims to deter others from engaging in similar activities and to protect the secrecy of its future projects. Additionally, the legal action underscores the studio’s commitment to preserving the element of surprise for audiences.

If Marvel’s legal efforts are successful in uncovering the identity of the leaker(s) behind CanWeGetSomeToast, it could have broader implications for online spoiler culture. The outcome of this case may set a precedent for how social media users share confidential information about upcoming films and television shows, potentially leading to stricter enforcement of copyright laws and intellectual property rights.
